VA Mesothelioma Benefits: Compensation for Veterans With Asbestos Exposure

Veterans who served from the 1930s into the 1980s face a heightened risk of developing mesothelioma and other asbestos-related diseases. Asbestos was widely used throughout the 20th century because of its heat resistance and durability. The military relied heavily on it in shipbuilding, aircraft insulation, barracks construction, and mechanical systems across every branch of service.

Although asbestos use declined by the 1980s, millions of service members had already been exposed, and many continued to encounter asbestos in aging ships, bases, and equipment. As a result, a disproportionate number of mesothelioma diagnoses involve military veterans.Veterans diagnosed with asbestos-related diseases may qualify for disability compensation and other benefits through the Department of Veterans Affairs. Oslund Udo Little has represented mesothelioma victims throughout the Pacific Northwest since 1995 and helps veterans pursue both VA benefits and additional legal claims where appropriate.

Am I Eligible For VA Disability Compensation?

You may be eligible for VA disability compensation if your mesothelioma or other asbestos-related disease is connected to your military service. Veterans who were exposed to asbestos while serving in the Navy, Army, Air Force, Marine Corps, or Coast Guard often qualify for monthly tax-free benefits. VA disability compensation is available when the claim meets the service connection requirements.

To be eligible, both of the following must be true:

  • You have a diagnosed health condition caused by exposure to asbestos.
  • You were exposed to asbestos while serving in the military.

The VA does not require definitive proof of exposure. Instead, the standard is whether it is at least as likely as not that your illness is service-connected. To support your claim, you will likely need proof such as military service records, duty assignments, ship or base records, and medical documentation.

What Types of VA Disability Benefits Are Available in 2026?

The Department of Veterans Affairs provides several types of benefits to veterans living with service-connected conditions. These may include monthly disability compensation, VA health care, pension programs, and additional payments for qualifying dependents, such as spouses, children, or parents.

VA Disability Compensation for Mesothelioma and Asbestos-Related Diseases

VA disability compensation provides monthly tax-free payments based on a disability rating assigned in 10 percent increments. The rating reflects the severity of your condition and determines your monthly payment amount.

Mesothelioma is rated at 100 percent disabling because it is classified as an active malignant respiratory cancer. Lung cancer is also rated at 100 percent disabling while active. Asbestosis is rated from 10 to 100 percent disabling, depending on pulmonary function testing. Pleural plaques and pleural effusions may be rated from 0 to 100 percent based on measurable respiratory impairment. Other asbestos-related respiratory cancers may also qualify for a 100 percent rating while active.

The compensation amounts below reflect 2026 VA figures and show how payments increase based on severity and dependent status.

VA Health Care Benefits

In addition to disability compensation, many veterans qualify for medical care through the U.S. Department of Veterans Affairs. VA health care may include preventive services, specialist care, hospital treatment, prescription coverage, and access to VA cancer treatment centers.

To qualify, you generally must have served in the active military, naval, or air service and not received a dishonorable discharge. Veterans who enlisted after September 7, 1980, or entered active duty after October 16, 1981, are typically required to have served 24 continuous months or the full period for which they were called to active duty, subject to certain exceptions.

Veterans with service-connected conditions, including mesothelioma, are often placed in higher priority groups, which can reduce or eliminate out-of-pocket costs and improve access to care.

Current VA Pension Rates for Veterans With Asbestos-Related Illnesses

The Veterans Pension program provides tax-free monthly payments to wartime veterans with limited income and net worth. Pension is a need-based benefit and is separate from VA disability compensation.

You may qualify if all of the following apply:

  • You did not receive a dishonorable discharge.
  • Your family’s annual income and net worth meet limits set by Congress.
  • You served during a recognized wartime period and meet the VA’s active-duty length requirements.

In addition, you must meet at least one of these conditions:

  • You are age 65 or older.
  • You have a permanent and total disability.
  • You live in a nursing home due to your disability.
  • You receive Social Security Disability Insurance or Supplemental Security Income.

Veterans with dependents may receive higher payments. Eligible dependents include a spouse, children under 18, children ages 18 to 23 attending school, and children over 18 who are permanently incapable of self-support.

Veterans Aid and Attendance Benefits

Veterans with mesothelioma or other serious asbestos-related illnesses may qualify for Aid and Attendance if they already meet eligibility requirements for VA Pension. Aid and Attendance is an increased pension benefit for veterans who need regular assistance with daily activities due to disability.

You may qualify if your condition:

  • Requires help with activities such as bathing, dressing, eating, or managing medications
  • Requires you to remain in bed due to disability
  • Results in significant visual impairment
  • Requires care in a nursing home because of physical or mental incapacity

Benefits and Compensation for Families of Veterans Exposed to Asbestos

The VA doesn’t only offer benefits for veterans with mesothelioma. Certain family members of veterans diagnosed with asbestos-related illnesses may also qualify for VA benefits.

VA Dependency and Indemnity Compensation

Surviving spouses, children, and parents of veterans who died from service-related illnesses, including asbestos-related diseases like mesothelioma, are often entitled to VA Dependency and Indemnity Compensation, or DIC. DIC is a tax-free monthly benefit.

The specific eligibility criteria and the duration for which the VA will pay this benefit will depend on your relationship to the deceased veteran. If you are the surviving spouse of a veteran, you will likely receive more long-term benefits than a parent.

Health Care for Dependents

VA Health Care is usually reserved for veterans, but some non-veteran family members may qualify for these benefits.

  • TRICARE: Provides comprehensive health coverage to spouses and children of military retirees and certain surviving family members of service members who were eligible for TRICARE at the time of death.
  • CHAMPVA: Offers health coverage to spouses and dependent children of veterans who are permanently and totally disabled due to a service-connected condition, as well as surviving spouses and children of veterans who died from a service-connected disability.

VA Survivors' Pension Eligibility for Spouses and Children

The VA Survivors Pension provides monthly, tax-free payments to eligible surviving spouses and unmarried children of deceased wartime veterans.

To qualify, the veteran must have served during a period of war and not received a dishonorable discharge. The surviving spouse must generally not have remarried, and household income and net worth must fall within limits set by Congress.

Eligible children must be unmarried and either under age 18, between 18 and 23, and attending a qualifying school program, or permanently incapable of self-support due to a disability that began before age 18.

Funeral and Burial Benefits & Reimbursement for Veterans

If your loved one died due to a service-related illness, including mesothelioma from asbestos exposure in the military, you’re likely entitled to compensation for funeral and burial expenses. This benefit can help to ease the financial burden of the death on your family.

The VA will pay up to $2,000 toward your loved one’s burial expenses, regardless of the burial place. The VA will also reimburse the cost of transporting the deceased if the burial occurs in a VA national cemetery. Additionally, you can request a free government headstone or grave marker at any cemetery worldwide.

VA Education Benefits

The VA offers compensation for educational expenses, including tuition and fee payments, money for books and supplies, and monthly housing allowances, to the spouses and children of veterans with significant service-connected disabilities.

If your spouse or parent is permanently and totally disabled or died as a result of mesothelioma or another asbestos-related disease stemming from military service, you likely qualify for VA education benefits.

How Do I Apply for VA Benefits?

Each VA benefit program has its own application process, but disability claims for mesothelioma and other asbestos-related diseases require medical and service documentation showing that your condition is connected to your military service.

To support a VA disability claim, you will generally need the following:

  • Military service records confirming your period of service and discharge status
  • Medical records documenting your diagnosis and treatment
  • A medical opinion linking your asbestos-related illness to your military service

In some cases, the VA may request additional details about where and how your asbestos exposure occurred during service. If more medical evidence is needed, the VA may schedule a Compensation and Pension examination to evaluate your condition.

If the VA denies your claim or you disagree with the disability rating assigned, you have the right to seek further review or appeal the decision.

What Other Mesothelioma Compensation Options Am I Eligible For?

You may be eligible for other types of compensation in addition to benefits from the VA if you have been diagnosed with mesothelioma as a veteran. When you turn to the team at Oslund Udo Little with your mesothelioma case, we’ll explore every available option to seek the maximum compensation for your losses.

Mesothelioma Claims

You can’t sue the U.S. military for your asbestos exposure. However, you could potentially file a mesothelioma lawsuit against third-party asbestos companies, such as the manufacturers that supplied products containing asbestos to job sites in the military. These claims seek financial compensation for damages and losses caused by the disease, including medical expenses, lost income, and pain and suffering.

Asbestos Trust Funds

Many companies responsible for asbestos-related diseases have filed for bankruptcy protection. Courts ordered many of these companies to establish asbestos trust funds as a part of their reorganizations or liquidations. These trust funds provide compensation to victims of asbestos exposure, including veterans. You may be eligible to seek compensation for your mesothelioma-related losses by filing a claim with the specific trust fund that applies to your case.

How Long Does It Take To Receive My Compensation?

In many cases, receiving compensation through these alternative legal avenues takes only a few months. Mesothelioma claims often have short waiting times since asbestos exposure is the primary cause of mesothelioma. However, the exact time to receive your compensation will depend on various factors, such as the quality of evidence supporting your case and how many claims the trust fund is currently processing.
