The asbestos claim process begins with a thorough investigation. During this process, we’ll collect medical records documenting your asbestos-related illness and gather occupational evidence to trace where your exposure likely occurred. 

Depending on your case’s complexity, the investigation stage typically takes from one to three months. What happens next depends on how the at-fault company is structured. 

Asbestos Trust Fund Claim

We may file an asbestos trust fund claim if the company responsible for your illness is bankrupt. Trust fund claims often resolve within six to twelve months without formal legal proceedings, and we may negotiate a settlement on your behalf. 

Asbestos Personal Injury Lawsuit

If the liable company doesn’t have a trust fund established, we’ll file a personal injury lawsuit instead. After we file, your case will enter discovery, where both sides will exchange evidence. This process often lasts six to eighteen months.

After and during discovery, we’ll pursue settlement negotiations. Most cases resolve at this stage.
